Sample Contract

Every puppy sold is placed on either a pet, show or performance/working contract.  The details will vary depending on the puppy, breed and type of contract.  A typical contract would be similar to the one below writen for a Border Collie.  However, at times we do use co-own contracts and puppy-back contracts depending on the situation.  Prospective puppy buyers will know well in advance of any such clause in their contract.

Sales Contract & Health Guarantee

I, Jamie Beaver (hereinafter designated as BREEDER), guarantee this Border Collie puppy to be healthy and free

of disease upon receipt by BUYER.  Every effort has been made by BREEDER to produce a litter both physically

and mentally sound.  BREEDER will stand behind this breeding to the extent stated below.  However, BUYER accepts

full responsibility for the proper care once the pup leaves the BREEDER.  BREEDER cannot be held responsible for

the death, injury, deformity, or temperament of the pup due to illness, accident, or deviation from adequate care and

socialization required for a Border Collie.

BUYER agrees to have this puppy examined by a licensed veterinarian within 72 hours of receipt.  If health problems

are found, the animal may be returned to the BREEDER at BUYERS expense.  Arrangements are to be made within 24

hours of diagnosis by a licensed veterinarian.  If the pup is returned for health reasons the BREEDER reserves the right

to replace the puppy with one of equal quality from the same, or subsequent litters.  The BREEDER also has the right to

choose to refund the purchase price of the puppy less any non-refundable deposits.  If the pup is returned for reasons

other than health related issues within the allotted time, the purchase price will also be refunded, less the non-refundable

 deposit.  If negligence on the behalf of the BUYER is suspected the BUYER forfeits all rights to puppy and all rights to

reclaim moneys rendered for puppy.  BUYER will return all registration and documentation materials at the time of the pups

return.  BREEDER is not responsible for any veterinary expenses incurred by the BUYER.

 BUYER agrees to pay $______________________ for this (PET/SHOW/BREEDING) Border Collie described below:

$________ of this payment has been paid as a binder to reserve the aforementioned pup.  Remaining payment must be received

in full by cash or money order made payable to “Jamie Beaver” before puppy is delivered to buyer.  All transportation expenses

are the responsibility of BUYER.  The $_____ deposit is NON REFUNDABLE.

 This puppy is sold under than one of three conditions. Both BUYER and BREEDER agree upon this condition and indicate so by initial

after the condition.   Those conditions are as follows:

 

  • PET PURPOSES:  This Border Collie is sold with the intention that it be used as a pet animal.  The BUYER agrees to

  • have this dog surgically sterilizedbetween six (6) and eighteen (18) months of age.  If the BUYER chooses not to sterilize                                                                                                                          this “pet” quality dog and decides to breed it; BREEDER makes no guarantees as to the quality of the offspring.

  • THE PUPPY WILL HAVE LIMITED ISTRATION WITH THE AKC, and the off spring will not be eligible for registration.

  • SHOW PROSPECT:  This Border Collie is sold with the intention that it will be used as a show animal.  The BREEDER                                                                                                                                                    guarantees that this dog has no defects i.e. (bad bite, blue eyes) that would disqualify this dog from being shown in                                                                                                                                                conformation events.  However, the BREEDER does NOT guarantee that said dog will win in the show ring, as that must                                                                                                                                                    depend on the training of the dog, showmanship of the handler, and commitment of the owner. 

  • BUYER agrees to show dog actively, at least a minimum of ten (10) shows in the first three (3) years of the dog’s life. 

  • BUYER also agrees to keep the BREEDER notified of the dog’s progress and points, along with forwarding photograps for                                                                                                                           inclusion on BREEDERS web site.

  • BREEDING PROSPECT:  This Border Collie is sold with the intention that it will be used as a breeding animal. 

  • BREEDER guarantees that this dog has no obvious defects that would prohibit the siring or whelping of healthy pups. 

  • However, this dog is considered NON-BREEDING until such time as OFA or PEN Hip, and CERF examinations have been performed. 

  • BUYER agrees to sterilize the dog should it not pass the OFA or PEN hip and CERF examinations. 

  • BUYER also agrees that the dog will only be bred with another registered Border Collie that has also passed the OFA and or PEN                                                                                                                                          Hip and CERF examinations.

BREEDER will remain as co-owner of dog.  This entitles the BREEDER the right to advise BUYER regarding the breeding potential

of dog and the right of ownership of dog in the event the BUYER is unable to keep the dog.  If BUYER is unable to keep the dog for

any reason, BUYER agrees to return it to BREEDER at buyer’s expense and foregoes all rights to said dog.  This dog may not be sold,

transferred to another person, given away, placed in an Animal Shelter, or euthanized without written permission from BREEDER. 

The exception to euthanasia would be in the case of severe injury or suffering on the part of the dog.  BUYER agrees to provide for

the dog in their will providing that the dog returns to the BREEDER.

 BUYER agrees to have the American Kennel Club registration to be:

ZEN’S _______________________ (a name chosen from an approved theme list for the litter).  BUYER agrees to have the

American Border Collie Association registration name to be ZEN’S_________________ and the chosen call name by buyer.

BUYER agrees to provide adequate fencing (at least 5 feet height) adjacent to and accessible from BUYER’S home to ensure this

dog’s safety; and to provide adequate protection from heat and cold.  This dog shall be neither continuously tied nor allowed to roam

at large.

BUYER agrees to obedience train and properly socialize this dog with a professional trainer, and to provide adequate veterinary

care, including, but not limited to annual checkups including heartworm and fecal tests; to keep all immunizations current according to

American Veterinary Medical Association guidelines; to properly administer heartworm and flea preventative; and to provide necessary

medical treatment in the event of accident/injury to the dog.

BUYER agrees to feed a high quality complete dog food containing no “meat by-products’ with 22-27% protein and 12% fat levels that

maintain the dog in appropriate body condition.  BREEDER recommends Natures Variety and Eagle Pack Foods. 

Many other brands of food are acceptable, however, grocery store brands and Science Diet are not recommended unless prescribed

by a State licensed Veterinarian.  A slightly lower fat and protein requirement may be needed for sedentary, sterilized and senior

pets.

BUYER agrees to have the American Kennel Club registration to be:

ZEN’S _______________________ (a name chosen from an approved theme list for the litter).  BUYER agrees to have the

American Border Collie Association registration name to be ZEN’S_________________ and the chosen call name by buyer.

CONTACT:  BUYER and BREEDER both agree to keep in contact with one another regarding the dog.  They both agree to keep one

another notified of changes of address or telephone number.  BUYER agrees to send one photograph per year to BREEDER of the dog

to show the dog’s maturation and health status.  BUYER agrees to keep identification tags/microchip/tattoo on dog in the case that the

dog is lost.

BUYER acknowledges the receipt of the following documents by initial.

HEALTH GUARANTEE

GUARANTEE:  This dog is guaranteed to be free of hereditary hip dysplasia upon permanent radiographic evaluation performed at

24-30 months of age.  BUYER agrees to have this dog’s hips radiographically examined by a State licensed Veterinarian and then sent

to the Orthopedic Foundation for Animals in Columbia, Missouri, for evaluation.  Upon receipt, a copy of the evaluation will be sent to

BREEDER.  If hip dysplasia is diagnosed due to genetic defect, and all prerequisites have been met for the health and well being of

the dog as specified in this contract, BREEDER will (at his/her discretion) refund one-third of the contract price.  Should hip dysplasia

be discovered later in life, than 24-30 months, the BREEDER will not provide for any refund.  BUYER agrees to have this puppy examined

by a licensed veterinarian within 72 hours of receipt.  If health problems are found, the animal may be returned to the BREEDER at BUYERS

expense.  Arrangements are to be made within 24 hours of diagnosis by a licensed veterinarian.  If the pup is returned for health reasons the

 BREEDER reserves the right to replace the puppy with one of equal quality from the same, or subsequent litters.  The BREEDER also has the

right to choose to refund the purchase price of the puppy less any non-refundable deposits.  If the pup is returned for reasons other than

health related issues within the allotted time, the purchase price will also be refunded, less the non-refundable deposit.  If negligence on the

behalf of the BUYER is suspected, the BUYER forfeits all rights to puppy and all rights to reclaim moneys rendered for puppy.  BUYER will

return all registration and documentation materials  at the time of the pups return.  BREEDER is not responsible for any veterinary expenses

ncurred by the BUYER.  Should BUYER neglect to have pup examined within allotted time, BREEDER assumes NO RESPONSIBILITY for any

 communicable disease nor injury of the pup.  Also should BUYER not maintain the initial puppy vaccination schedule, the BREEDER IS NOT

RESPONSIBLE for any communicable disease obtained in the pup’s future.

Receipt and Holding Agreement

 

The following agreement is between Jamie Beaver, hereafter known as BREEDER, and ____________________________,

hereafter known as BUYER. 

In consideration of a deposit of $200, of which $200 is a non-refundable deposit, BREEDER assigns BUYER the option to acquire

the dog described below, guaranteeing that the dog will not be sold to any party other than the purchaser for a period of 8 weeks

following the birth of the dog.  At the time BUYER acquires physical possession of the dog, the deposit taken now will be applied to

the purchase price.  The balance of the sales price is due at time of transfer.

BUYER assumes all responsibilities for the dog as of the date and time of this agreement.  BREEDER will not be held responsible for

illness and or injury to the dog except, as that illness and or injury would have been avoided by the exercise of reasonable and normal

care.  BREEDER reserves the right to substitute puppy with one of equal or greater value at her discretion if it is deemed another

puppy would be more suited to the BUYER’S needs.

The security deposit received by seller in the amount of $200 is non-refundable.   If at any time the BREEDER feels that the

 health and safety of the puppy would be compromised by completion of the sale of the puppy to BUYER, the BREEDER reserves the

 right to cancel this agreement at any time and refund the full amount of security deposit.
